Terms and conditions
The client undertakes not at any time in the future to employ any of the models and associates introduced to them through SUGARBABES MODEL AGENCY in capacity whatsoever without the written consent of Sugarbabes.
1.0 BOOKINGS
1.1 For Photographic assignments the minimum bookings is two hours. The working day is 8 hours between 09.00 hours and 18.00 hours and includes a one-hour lunch break. For press days, shows and promotional assignments the minimum booking is a half-day (four hours).
1.2 Overtime Rates are as follows:
(a) The overtime rate is 150% of the normal hourly rate between 18.00 and 24.00 hours.
(b) Work on Saturdays is 150%, Sundays and Bank Holidays is 200% of the normal hourly rate.
(c) Special rate is negotiated for night shoots between 24.00 and 09.00 hours.
1.3 Travelling Time and expenses - travel time and expenses is included in fee for bookings in London, otherwise there will be travel expenses and time charged to client outside London.
1.4 Fittings - fees to be 50% of hourly rate, minimum 2-hour booking.
1.5 Poster and Showcard Fees/Pack and Record Covers - these are subject to special negotiations.
1.6 Party bookings - the minimum booking is for 3 hours, and is to include a break for the artistes, all travel expenses are included in fee if in London, travel to be paid on the day direct to model if the booking is outside London. Any party bookings where as the finish is after 1am then the client will be expected to pay for each model's taxi fare home.
2.0 PROVISIONAL BOOKINGS - will be cancelled automatically if they are not confirmed by the client within 24 hours of proposed booking.
3.0 CANCELLATIONS - Model bookings cancelled within twenty-four hours of the commencement of the booking will be charged at full fee.
4.0 ADDITIONAL FEES
4.1 Usages - Additional fees are liable when photographs (or reproductions and adaptations of part or complete picture) are used for other purposes than those originally commissioned for. The client is wholly responsible for notifying Sugarbabes of any changes to this commission.
4.2 Territory - Additional fees are liable when photographs (or reproductions and adaptations of part or complete picture) are used in territories other than the UK or those originally commissioned for. The client is wholly responsible for notifying Sugarbabes of any changes to this commission.
4.3 Exclusion Fees - A special fee will be negotiated when the assignment is in connection with a product, which precludes work for competing. The client is responsible for interpreting whether competing assignments have been undertaken. When a model endorses a product, they are able to complete assignments for any other competitor unless an exclusion fee has been agreed.
5.0 INVOICING.
(a) Sugarbabes standard practice is to accept bookings as a contract over the telephone. The client responsible for commissioning the booking will be invoiced and is solely responsible unless otherwise agreed at the time of the booking.
(b) All party bookings will require a 50% deposit at time of booking and the remainder of the payment to be paid within 7 days of the booking.
(c) The client is liable to pay Sugarbabes for the agreed contract irrespective of any post assignment contentions.
(d) Use of the photographs is not permitted until payment for all fees has been made.
(e) The agency fees, the model fees, and disbursements will be invoiced by Sugarbabes unless otherwise negotiated at the time of the booking.
5.1 Payment - payment for photographic assignments must be made within 30 days from the completion of the assignment. Payments for press days, shows, and promotional assignments must be made within 7 days from the completion of the assignment. Payments for parties must pay 50% of total invoice before assignment and the remainder to be paid within 7 days of completion of the assignment.
5.2 Copyright - The client commissioning the photographs (or reproductions and adaptations of part or complete photograph) is restricted by copyright. The copyright is negotiated by Sugarbabes at the time of the booking. The usage (4.0 and invoicing 5.2) regulates this copyright.
6.0 REPRODUCTION RIGHTS
6.1 Images - All images and details reproduced in association with Sugarbabes are supplied by the individual model and/or their associates and with the full permission and consent of the individual model/associates. Sugarbabes cannot be held responsible for any loss howsoever caused through the model misrepresenting themselves in any way.
6.2 Media Reproductions - Sugarbabes reserves all rights to reproduce in any media (electronic, telegraphic, print, etc) any images supplied to Sugarbabes by any individual model/associate.
6.4 Lawful contract - All models/associates on submitting any images to Sugarbabes give all reproduction rights to Sugarbabes and lawfully accepts and abides by all the terms and conditions set and modified at any time by Sugarbabes.
